Corzine Signs Property Tax Credits and Property Tax Cap Legislation

Governor Jon Corzine on April 3 signed into law the final two pieces of property tax reform legislation. The new laws provide property tax credits, cap property tax increases and make it easier for local governments to share services.

Corzine signed A-1 (Roberts, McKeon)/S-20 (Codey, Kenny), which will provide property tax credits of 20 percent to homeowners with annual household incomes under $100,000; 15 percent for those with incomes between $100,000 and $150,000; and 10 percent for those with incomes between $150,000 and $250,000. The measure also caps the amount by which local governments can increase property taxes at 4 percent per year. However, the cap includes numerous exemptions, such as reductions in State aid, certain debt and interest payments, and health insurance increases above 4 percent.

An important provision of the law will allow local governments to negotiate health insurance premium cost-sharing arrangements with employees enrolled in the State Health Benefits Plan.

The Governor also signed A-4 (Roberts, Wisniewski)/S-10 (Smith), which makes it easier for municipalities and school districts to voluntarily share services. The measure provides for greater local government budget transparency, simpler rules to facilitate local government regionalization and cooperation, and a greater oversight role for county school superintendents to push local school districts towards more cost-cutting, efficiency and cooperation. NJPRO Study: High Costs, Uncompetitive Policies Hurt New Jersey's Business ClimateCompared to most other states, New Jersey has higher taxes, health insurance costs and energy costs as well as less competitive business policies, according to a new report by the New Jersey Policy Research Organization (NJPRO) Foundation, the research affiliate of the New Jersey Business & Industry Association. Entitled New Jersey's Business Climate, How Policy and Perception Are Affecting New Jersey's High-Tech and Manufacturing Sectors, the report compares New Jersey to other states on health insurance, business taxes, individual taxes, competitiveness, and the overall cost of doing business.

New Jersey does have some advantages over other states. It is strategically located in one of the most densely populated and wealthiest consumer markets anywhere in the world and has a highly skilled and educated workforce. But the high cost of doing business does not allow New Jersey to reach its economic potential. The report also noted that New Jersey is creating private-sector jobs at a significantly slower rate than most other states. Among the findings:

• New Jersey's government policies are the worst in the nation in promoting small business growth and entrepreneurship (Source: 2006 Small Business Survival Index).

• Rigid environmental policies and aging infrastructure dragged down good scores in other areas to make New Jersey 43rd in its overall economic competitiveness (Source: Beacon Hill Institute 2006 State Competitiveness Report).

• Only two states—Ohio and Rhode Island—have a worse business tax climate than New Jersey (Source: The Tax Foundation’s 2007 State Business Tax Climate Index).

• New Jersey has the seventh highest cost of doing business, with costs over 20 percent higher than the national average (Source: Milken Institute Cost of Doing Business Index).
